Juan Darthés condenado a prisión efectiva por la violación de Thelma Fardin.

La Justicia de Brasil dejó firme la condena a seis años de prisión efectiva para el actor Juan Darthés por abuso sexual contra la actríz Thelma Fardin, cuando ella tenía 16 años. El Tribunal Regional Federal de la 3ª Región en San Pablo, rechazó las apelaciones presentadas por la defensa y confirmó la sentencia en régimen semiabierto para el actor.

The Federal Regional Court of the 3rd Region in São Paulo rejected the appeals filed by the defense and confirmed the sentence, which will be served under a semi-open regime.

¿Cómo fue el caso?

Thelma Fardin actuaba en la exitosa serie 'Patito Feo' que incluyó giras por América Latina. Durante uno de los viajes del elenco, Fardín denunció que Juan Darthés la violó, en el hotel donde se hospedaban en Nicaragua. Esto ocurrió en 2018.

"Este fallo que condena a Juan Darthés marca un importante hito en la historia judicial de América Latina. Darthés fue absuelto en Nicaragua porque habían transcurrido suficientes años como para que la causa prescriba. En Argentina el caso no podía juzgarse, toda vez que ocurrió en Nicaragua y en el caso de Brasil, pudo llevarlo a cabo porque Darthés es brasileño de nacimiento. Entonces hubo colaboración de los fiscales de los tres países para llegar al proceso definitivo en Brasil. La violación de Thelma Fardin, de 16 años al momento de los hechos, es un hecho lo suficientemente grave como para no dejarlo pasar y la justicia de Brasil ha demostrado estar a la altura", dijo el Dr. Javier Miglino Helfenstein, Experto en Derechos Humanos y Protección de la Niñez.

What happened?

Thelma Fardin was acting in the hit series "Patito Feo," which included tours throughout Latin America. During one of the cast's trips, Fardin reported that Juan Darthés raped her in the hotel where they were staying in Nicaragua. This happened in 2018.

"This ruling that convicts Juan Darthés marks an important milestone in the judicial history of Latin America. Darthés was acquitted in Nicaragua because enough years had passed for the statute of limitations to expire. In Argentina, the case could not be tried, since it occurred in Nicaragua, and in Brazil, it could proceed because Darthés is Brazilian by birth. Therefore, there was collaboration among prosecutors from the three countries to reach the final trial in Brazil. The rape of Thelma Fardin, who was 16 years old at the time of the events, is a serious enough crime not to be ignored, and the Brazilian justice system has proven itself up to the task," said Dr. Javier Miglino Helfenstein, an expert in human rights and child protection.
